JESIKI'S LICENSING AGREEMENT, TERMS OF SERVICE, AND TERMS OF USE

JESIKI — Artist, seller, producer
The User — Commissioner, owner and/or buyer
Artwork(s) — Illustrations produced by JESIKI
Design(s) — Character designs produced by JESIKI
Signature — Signature, watermark
Terms — Terms of Service, Terms of Use, Personal Use AgreementThis LISCENSE AGREEMENT, TERMS OF SERVICE, AND TERMS OF USE ("Agreement") is between JESIKI and The User.THEREFORE, it is agreed between both parties as follows:

1.1 The User's Grants

JESIKI herby grants(✓) or does not grant(✗) a personal use license of the Artwork(s) or Design(s) for The User in respect to the following terms:

  • Can use the Artwork(s) or Design(s) for personal use assuming the Personal Use License:

  • Reposting and/or sharing the Artwork(s) or Design(s) with appropriate credit corresponding to the platform. If not applicable, credit using any of JESIKI's active platforms;

  • Editing and/or compositing the Artwork(s) or Design(s) while keeping the Signature visible and/or JESIKI's social link(s) accessible;

  • Tangibilizing the Artwork(s) or Design(s).

  • Can resell the Artwork(s) or Design(s) for the original amount paid ("Initial Purchase Price"), and in the case for Design(s), the adjusted value from additional Third Party artwork(s), considering only their exact monetary value ("Market Value"), or less to a Third Party.

  • Cannot use, redistribute, tangibilize, or sell the Artwork(s) or Design(s) to a Third Party for commercial use.

  • Cannot sell/mint the Artwork(s) or Design(s) to a Third Party as Non-Fungible Tokens (NTFs).

1.2 Specific Grants for Design(s)

JESIKI herby grants(✓) or does not grant(✗) a personal use license of the Design(s) for The User in respects to the following terms:

  • Can resell the Design(s) for the Initial Purchase Price, the adjusted Market Value, or less.

  • Can modify the Design(s) so long as it resembles its original appearance, has its Signature intact, and is appropriately credited to JESIKI.

  • Cannot evaluate additional Third Party artwork(s) with no monetary value into the Market Value of the Design(s).

  • Cannot sell or trade the Design(s) to a Third Party outside of ToyHou.se.

  • Cannot delete the Design(s) profile off of Toyhou.se or hide the Design(s) profile. The Design(s) must remain visible to JESIKI.

2.1 JESIKI's Rights

  • Allowed to post the Artwork(s) or Design(s) on any platform.

  • Allowed to cancel and/or decline requests. Full refunds applicable.

  • Cannot further distribute and/or sell the Artwork(s) or Design(s) UNLESS the agreement is violated.

3.1 JESIKI'S Payment Terms

  1. Payments are upfront via: https://www.paypal.me/Jesiki (USD) or https://www.deviantart.com/jesik1

  2. Refunds are negotiable ONLY during the process of creation.

3.2 JESIKI'S Refund Policy

  1. FULL REFUND when the following are completed:

  • Draft

  • Thumbnail(s)

  1. PARTIAL REFUND when the following are completed:

  • Line art (70%)

  • Base colours (60%)

  • Cell shading (50%)

  1. NO REFUNDS after the aforementioned stages or once the product is completed.

Disclaimers

Failure to adhere warnings and abide JESIKI's Terms will nullify The User's Grants to all Artwork(s) and Design(s). Therefore, permitting JESIKI to resell, redistribute, and/or claim full ownership of the Artwork(s) or Design(s).
